论大运河立法体系的构建

摘要：在现行的法律体系中,有关运河的称呼有“运河”“大运河”“中国大运河”乃至“古运河”等。这些名称代表了立法者对运河的基本认识和价值判断。从立法体系演变过程来看,大致可以区分为“运河立法体系”和“大运河立法体系”两个阶段。尽管大运河立法体系已经初具规模,但是仍然面临着立法对象不够清晰、立法目的把握不准、立法范围交叉重叠以及立法体系尚未成型等正当化难题。借鉴域外运河立法经验,大运河立法体系构建不能局限于世界文化遗产所确定的保护范围,而必须具有自己独特的视角：一是以大运河为立法对象,拓展大运河立法区域空间,开展大运河综合性立法；二是以大运河文化保护传承利用为立法目标,树立长尺度、跨区域保护发展立法理念；三是以大运河行政法规、地方性法规和规章为立法形式,形成大运河立法结构体系；四是以大运河保护、促进和管理为立法维度,使大运河规划和大运河立法相辅相成,相得益彰。

Abstract: Within the current legal system, various terms such as “canal” “Grand Canal” “China’s Grand Canal” and even “Ancient Canal” are used to refer to the canal. These designations reflect the fundamental understanding and value judgments of legislators regarding the canal. Examining the evolution of the legislative system, it can broadly be divided into two stages: the “Canal Legislative System” and the “Grand Canal Legislative System”. Although the Grand Canal legislative system has begun to take shape, it still faces legitimacy challenges, including an unclear legislative object, imprecise grasp of legislative purposes, overlapping legislative scopes, and an underdeveloped legislative system structure. Drawing on the legislative experiences of canal systems from other jurisdictions, the construction of the Grand Canal legislative system must not be confined solely to the protection boundaries established for the World Cultural Heritage site. Instead, it requires its own unique perspective: First, taking the Grand Canal itself as the legislative object, expanding the spatial scope of Grand Canal legislation, and undertaking comprehensive legislation for the Grand Canal. Second, setting the protection, inheritance, and utilization of Grand Canal culture as the legislative goal, and establishing a long-term, cross-regional legislative philosophy for protection and development. Third, utilizing administrative regulations, local regulations, and rules as legislative forms to create a structured Grand Canal legislative system. Fourth, focusing on the protection, promotion, and management of the Grand Canal as legislative dimensions, ensuring that Grand Canal planning and Grand Canal legislation complement and reinforce each other.
